In the case Does I-IX,Workers in China… v. Walmart Stores in your textbook, some employees of Walmart’s suppliers wanted to sue Walmart for not following up to make sure those suppliers were following local law (as required in their contracts). These employees allege that they were intended third party beneficiaries of those contracts and therefore should be allowed to sue when Walmart “breached” the contracts. The court sided with Walmart saying that these workers were NOT intended third party beneficiaries. In an original post explain why you agree or disagree with the court.
- Do you think Walmart should be concerned with the working conditions experienced by the employees in foreign countries in the first place?
- Why do you think Walmart puts these requirements in their contracts?
